SPECIAL MEMORIES FRESH SEMEN CONTRACT

This contract is made by and between the Dorothy Rowland and

________________________________________________________________  (Purchaser) 

for breeding of the mare named ____________________________________________ 

and the stallion Special Memories for the 2007 Breeding season.

THIS SERVICE IS SUBJECT TO THE FOLLOWING CONDITIONS:
1. The determination of the mare's condition for breeding is the purchasers responsibility.
2. A non-refundable Booking Fee of $ _______ is due at the signing of the contract.
3. The 2007 Breeding Fee is $_______ A 10% discount applies if booked by 2/28/07.

Stallion must be notified if mare to be used as embryo donor mare,  Use of semen for

embryo transfer donor mare that results in more than one live foal will require a

discounted breeding fee of $________   paid for each additional live foal born before

breeding certificate(s) will be issued.

4. Stallion will be collected at Select Breeders Services (SBS) at Colora Md. 

It is the purchasers responsibility to pay SBS directly for all collections fees and cost

of shipping the semen.    Stallion Owner will use best efforts to collect seven days

of the week but weekends will require courier service to the airport.  If the semen is

shipped from airport to airport, SBS will charge purchaser for courier fees for the

transportation to the airport. Make sure if requested Saturday delivery that FED EX

delivered  on Saturdays in your area.
5. If available, two packages of semen will be sent.  Please do not use both packages

in one insemination. Semen will stay viable if kept properly chilled for a second insemination.
6. Interest of 1.5% per month will be charged on outstanding balances.
7. The purchaser is responsible for teasing, calculating estrus and insemination of the mare.
8. It is the purchasers responsibility to contact the Stallion Owner immediately when the

mare comes into heat. The Stallion Owner  requests at least 24 hour notice to collect.
9. Further, it is agreed if the mare fails to conceive during the 2007 breeding season,

the stallion owner will collect and ship again in the 2008 if necessary. A veterinary

certificate to that effect is required. It will be the purchasers responsibility to pay the

collection and shipping charges. If the mare, after being checked in foal, aborts or does

not produce a foal to stand and nurse, a return privilege will be granted for the 2008

season, if necessary, without additional stud fee but the purchaser will be responsible for

collection and shipping charges. A veterinary certificate is required within ten (10) days

 from the date of death. This constitutes a two year live foal guarantee.  Upon notification,

a substitute mare may be used in the contract period.
10. It is further agreed that should the stallion die or become unfit before serving the

mare, frozen semen, if available, will replace fresh cooled semen for a total of up to two

doses or if the mare owner chooses a substitute stallion may be offer.  If the named

mare dies or becomes unfit to be bred, a mare may be substituted. 

11. This agreement shall be interpreted, construed and governed by the laws of the

State of Maryland.  The parties agree that if it is necessary for either party to file a lawsuit

arising out of this agreement, they will only file the lawsuit in Baltimore County, Maryland.

If any legal action is necessary to enforce the terms of this contract, the prevailing party

shall be entitled to reasonable attorney's fees and collection costs.

12. No breeding certificate will be issued until all fees have been paid.
13. When the Stallion Owner signs and returns one copy of this contract, it will be a

binding contract on both parties subject to the above terms and conditions and not

transferable or assignable.
